Welcome to ITT Publishing Inc. ("ITT Publishing," "we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of our website at ittpublishing.com and all associated digital content, reading platform, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Account Registration

Access to certain features of the Service requires creating an account. You agree to provide accurate, current, and complete information and to keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@ittpublishing.com if you suspect unauthorized use of your account.

3. Memberships and Digital Purchases

a. Memberships

ITT Publishing offers subscription-based memberships that provide access to our digital story library. Membership fees are billed on the schedule presented at the time of purchase (e.g., monthly or annually). All fees are stated in U.S. dollars and are non-refundable except as expressly set forth herein or required by applicable law.

b. Digital Content Purchases

Where individual digital content items are made available for purchase, you acknowledge that you are purchasing a limited, non-exclusive, non-transferable license to access and use that content for your personal, non-commercial use only. You do not acquire any ownership interest in purchased content. Digital purchases are final and non-refundable once the content has been accessed or downloaded, except where required by law.

c. Pricing and Payment

We reserve the right to change our pricing at any time. Changes to subscription pricing will be communicated in advance and will take effect at your next billing cycle. Payment is processed by third-party payment processors and is subject to their terms and conditions. You authorize us to charge your designated payment method for all applicable fees.

d. Cancellation

You may cancel your membership at any time through your account settings or by contacting us. Upon cancellation, you will retain access to the Service through the end of your current billing period. We do not provide pro-rated refunds for partial periods.

4. Intellectual Property and Copyright

a. Ownership

All content available through the Service — including but not limited to stories, text, images, audio, graphics, logos, page layouts, and software — is the property of ITT Publishing Inc. or its content licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. All rights reserved.

b. Copyright Holder Rights

Each story and creative work published through ITT Publishing remains the copyrighted property of its respective author or rights holder. ITT Publishing is granted a license to distribute such works through the Service. No content published on the Service may be reproduced, distributed, publicly performed, publicly displayed, transmitted, adapted, or otherwise used without the express prior written consent of the applicable copyright holder.

c. Limited License to Users

Subject to your compliance with these Terms and payment of applicable fees, ITT Publishing grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and view content through the Service for your personal, non-commercial use only. This license does not include the right to: (i) download, copy, or store content beyond what is expressly permitted; (ii) modify or create derivative works; (iii) publicly display or perform content; (iv) redistribute or resell content; or (v) remove any copyright, trademark, or other proprietary notices.

d. DMCA / Copyright Complaints

If you believe that content on the Service infringes your copyright, please send a notice to legal@ittpublishing.com containing: (i) identification of the copyrighted work; (ii) identification of the allegedly infringing material and its location on the Service; (iii) your contact information; (iv) a statement of good faith belief; and (v) a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner.

5. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Copy, scrape, crawl, or systematically extract content from the Service
• Circumvent, disable, or interfere with security-related features of the Service
• Share your account credentials or allow others to access the Service through your account
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Upload or transmit viruses, malware, or other harmful code
• Attempt to gain unauthorized access to any portion of the Service
• Use the Service to transmit unsolicited commercial communications (spam)

6. User-Submitted Content

If you submit any content to us (including writer submissions, feedback, or communications), you grant ITT Publishing a non-exclusive, royalty-free, worldwide license to use, reproduce, and publish such content in connection with evaluating your submission or operating the Service. You represent that you have all necessary rights to grant this license and that your submission does not infringe any third-party rights.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

The stories and content available through the Service are intended for personal reflection, entertainment, and connection. They are not a substitute for professional medical, psychological, legal, or financial advice.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ITT PUBLISHING INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless ITT Publishing Inc. and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of another party.

10. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or the integrity of the Service. Upon termination, your license to use the Service will immediately cease.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Illinois, USA, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Cook County, Illinois. You waive any objection to the laying of venue in such courts.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page with a revised effective date and, where appropriate, by notifying you via email. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.

13. Miscellaneous

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ITT Publishing Inc. regarding the Service and supersede all prior agreements. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
